Informal Meetings Detail

AGENDA OF INFORMAL MEETING OF ALL INDIA SCHEDULED CASTES & SCHEDULED TRIBES RAILWAY EMPLOYEES ASSOCIATION HELD ON 02/05/2012 AT RAILWAY BOARD, NEW DELHI.

Item No.1:- Extension of facilities to All India Scheduled Castes & Scheduled Tribes  Railway Employees Association:-

(i)  Grant full recognition to this Association for welfare activities on Indian Railways and involve in all the welfare activities going on Indian Railways.
ii)  Minimum 2 PNM meetings at Board/Zonal/Divisional/Workshop level.    
     
(iii)  Previously, the Parliamentary Committee on the Welfare of SCs/STs has been recommended Monthly Informal Meeting at Zonal/Divisional/ Workshop level and Railway have already been accepted the recommendation and subsequently withdrawn by the Railway. Please restore Monthly Informal Meeting at all level.

(iv)  At present the Card Pass facility is only for three office bearers i.e. for President, Secretary & Addl. General Secretary of CEC & Two card passes i.e. President & Secretary of ZEC. In addition to these card passes, it may please be extended for Working President, Sr.Vice President and Treasurer of Central Executive Committee, Working President, Addl. Zonal Secretary & Treasurer of Zonal Executive Committee and President, Secretary& Treasurer of Divisional/ Workshop/ Branch Executive Committees.

(v) As per bye laws of this Association and Railway Board’s instructions, the Annual Convention & Election of Committees and quarterly meeting of Association’s CEC/ZEC/DEC/BEC are required. But the Special Casual Leave & Special Passes to attend above meetings are not provided at all levels. Please grant Special Casual Leave & Special Passes to attend such meetings.    

(vi)  The Office Bearers of this Association are being transferred frequently, which adversely affects the smooth functioning of Association. The Office Bearers of this Association should not be transferred without consent of Zonal President and Zonal Secretary of Association as done in case of office bearers of trade unions.

(vii)  As per Rly. Bd’s. Instructions, representation of this Association are being entertained. But the compliance of representations is not being communicated in writing to this Association. Reply and compliance of Association’s representations may please be communicated in writing to this association.

(viii) The matters of staff welfare and to ensure more meaningful and effective participation of workers in the management process are decided in the PREM meeting but the participation of Association in such meeting is not provided.

We are not demanding this facility at par with AIRF/NFIR but we are requesting to extend this facility at par with other Associations i.e. IRPOF, FROA and AIRPFA. Please extend this facility to the Association to safe guard  the interest of SC/ST Railway  Employees.

(ix)   Grant of facilities to All India SC/ST Railway Employees Association- Participation of office bearers in Staff Benefit Fund Committee on Railways:- The Association has been demanding representation in the welfare committee/staff benefit fund committee since long. The Ministry of Railways contributes a generous amount to the fund for the staff benefit at affixed per capita rate for Railway Employees for Educational, Cultural, Recreational and a host of other activities including Scholarships for higher education, relief for distress sickness e.t.c.

The welfare committee/ Staff Benefit Fund Committee play a crucial role in disbursement and utilization of the above fund. It has been our experienced that the claims of SC/ST employees are either ignored or inordinately delayed. It is also seen that SC/ST Railway Employees are not included in the various activities, recreational camps e.t.c. held through SBF at various places.

This item was discussed and agreed to by MS/AMS during the last informal meeting held with the Board and also during the meeting with Board and MOS(R) earlier. We were therefore, hopeful of getting a positive response. It is surprise to note  that our proposal is being examined afresh in consultation with the Federations. This is certainly beyond our imagination that simple demand of our representation in the committee will be considered in consultation with the federations. We may like to mention that we are not subordinate or affiliate of any federations. We have our own independent status and position and we represent our SC/ST employees working over Indian Railways. It is necessary that the SC/ST employees get a fair share from the Benefit Fund. This can be ensured to a large extent by giving representation to the Association on the Welfare Committee (Staff Benefit Fund Committee)

Item No.2-  Issue of AC-1 Class pass to the President, General Secretary  & Addl.  General Secretary of this Association.                

The president and General Secretary of All India Scheduled Castes & Scheduled Tries Railway Employees Association have been issued All India Card Passes for travel in I class/ AC-II tier class. In AC II tier there is a little privacy and no important and urgent Association work of serious nature relating to reading & writing can be satisfactorily attended and safety/security to. It is, requested  that at All India (CEC’s) level, the president and General Secretary be issued card Passes for travel in AC-I Class.  Incidentally it may be mentioned that the President and General Secretary of NFIR, AIRF and AIRPFA are issued with AC-I Class passes.

During last meeting held on 15.12.2010, it was requested by the Association that at least whatever facilities have been granted to the Association should be equal to the federations and it was decided that this issue will be considered and the AC-1 card may be extended to this Association also. But the same has not been finalized till date

Item No.3 -  special casual leave and passes be allowed to members of Executive Committees at all levels from Branch to the Centre for attending the Executive Committee Meetings of BEC, DEC, ZEC and CEC.

Executive Meeting at the Central, Zonal and Divisional levels are held at least three or four times in a year. The members of these committees attended the Executive Committee Meetings with their own passes and causal leave. In this context it may be mentioned that special casual leave and passes are allowed informal meetings only. It may not be out of context to mention that the Executive Committee meetings are also equally important if not more then the informal meeting. It is hard to expect members to use their own passes and leave for attending executives committee meetings every time as the full quota of leave and passes will get consumed in  meetings only leaving no leave & passes for their own use and use of their families. This is affecting the attendance of members quite often as their leave and passes get exhausted.

It is, therefore, earnestly requested that special casual leave and passes should be allowed to members of Executive Committees at all levels from Branch to the Centre for attending the Executive Committee Meetings of BEC, DEC, ZEC and CEC.

Item No.4 -   Training /Management programmes regarding reservation rules, establishment matter e.t.c. be organized for office bearers of this Association.             

Training programmes/ Management programmes for Railway Employees and Unions workers are frequently held at Zonal levels. Some times such programmes specially in reference of reservation policy and roster system are also arranged at Management Institutions/others Institutions and officials and office bearers of the Unions are nominated by the Railway Board.  In this context it is mentioned that members of All India SC/ST Railway Employees Association are not being deputed for these trainings. It is, suggested that in these training programmes our members should also be deputed so that our members can also get equipped in various establishment rules.

It is also suggested that such training programmes should also be arranged about Reservation Rules. It may be mentioned that the Reservation Rules have undergone many changes during the last decade or so. Besides there have been many court cases – CAT,High Courts and Supreme Court. The reservation rules have undergone many changes at different levels in the light of these decisions of Court.

It is therefore suggested that training programmes should also be organised on Reservation policy of the Government and our membersshould be deputed for these programmes. Besides, staff dealing with Reservation Rules in Zonal Railways headquarters and Divisions should also be deputed to undergo such programmes.

Item No.5  Nomination of representatives  of All India Scheduled Castes &   Scheduled Tribes Railway Employees Association in Governing Body of  Indian Railway Welfare Organization.

Indian Railway Welfare Organization (IRWO)  was set up with certain  purpose of promoting social welfare scheme such as providing help to acquire accommodation to serving and retired Railway Employees on  “no profit  no loss’’ basis. This welfare organization has been registered under Societies Registration Act 1860.The Chairman, Railway Board, Ministry of Railways will be the patron of the organization. This organization will be managed by the Governing Body consisting Railway Official of Ministry of Railways including two representatives each from AIRF/NFIR and one representative each from Class I Railway Officers Association, Indian Railway Class II Officers Federation and Indian Railway Protection Force Association. There is no representation from All India Scheduled Castes & Scheduled Tribes Railway Employees Association.

In the above context it is submitted that the main object of this organization is to construct of houses through self financing scheme for Railway Employees working or retired those who are the members of the organization in all over the country. There are number of office orders regarding reservations for Scheduled Castes & Scheduled Tribes in allotment of houses/ lands & other schemes also . The All India SC/ST Railway Employees Association is registered under registration of Societies Registration Act- 1860 and recognized by the Railway Board as a Welfare organization and it is  moral responsibility of this Association to look after the proper implementation of policies in favour of SC/ST issued by the Government of India.

Association is requested issue necessary guide lines to nominate representatives of this Association as Ex. Office member of Governing Body of Indian Railway Welfare Organization and also cooperate them for safe guard the interest of Scheduled Castes & Scheduled Tribes employees of Indian Railways.

Item No.6 -  Provision of Railway Retiring Rooms, Rest Houses to the office bearers of this Association.                        

The office bearers, mostly General Secretary/President, Treasurer and Addl. General Secretary e.t.c., often visit various Railway establishments from time to time. The facility of Railway accommodation, however, is not allowed to our office bearers with the result the office bearers have to spend their own money towards Retiring Room charges.

It is requested that at least elected office bearers of DEC, ZEC and CEC be allowed facility of stay in the Railway Retiring Rooms, Rest Houses e.t.c. free of cost. This facility is allowed at present for attending informal meeting.

Item No.7 -Card passes already provided to the Zonal President & Zonal Secretary may be extended up to Delhi/ New Delhi alongwith their Zonal Jurisdiction.

The Zonal presidents and Zonal Secretaries of Zonal Executive Committees have been issued Card Passes for travel in I class/ AC-II tier class with the jurisdiction of their respective Zones. Some of the Railways issued card passes for travels in their Zone and up to Delhi/New Delhi. Being Central Office at New Delhi Zonal presidents and Zonal Secretaries regularly visit to Central Office.

It is requested that card passes may be extended up to Delhi/ New Delhi alongwith their Zonal Jurisdiction.

Item No.8-  lternative appointment of medically de-categorizedRailway Board vide there letters No.E(SCT) 58CM1/2/13 dt.25.11.1958 & dt.10.06.59 and letter No. E (SCT) 15/5 dt. 13.02.1976  have given instruction to the Railways that “ The Scheduled Castes & Scheduled Tribes direct recruits selected for a particular category, if declared medically unfit for that  category, be considered for such other categories  for which they are medically fit and there is  shortfall in the reserved quota to be made good under the personal powers vested with the General Manager. These orders were initially issued for Scheduled Castes & Scheduled Tribes candidates only. Later on these were extended to General Candidates. It is seen that these instructions have been withdrawn. It is mentioned that initially these instructions were issued only in respect of SC/ST medically failed candidates and were applied to General Candidate at a much later date. Withdrawal of this provision in case of SC/ST candidate is neither called for nor justified the Board should review this policy and restore the provision for SC/ST medically decategorised candidate for alternative appointment.

Item No.9  Illegal policy issued by the Railway Board for mutual transfer of SC/ST Railway Employees.

During last informal meeting held on 28/10/2009, it was requested by the Association that in terms of extant procedure vide para 102A, 310 and 312 of Indian Railway Establishment Manual, Vol.I 1989 read with administrative instructions issued from time to time, request transfers are allowed from one seniority unit to another on mutual exchange basis in any grade on own seniority or seniority of the employee with whom the exchange takes place whichever of the two is lower. The above provisions have been modified by the Railway Board vide letter No.E(NG)I-2004/TR/16 dated 14/08/2007 that transfers on mutual exchange basis should be allowed between employees belonging to the same category (i.e. General with General, SC with SC and ST with ST) which is against the basic rules of mutual transfer because the mutual transferred SC/ST candidates are being adjusted finally against the reserved roster points. Therefore, the above modification may please be withdrawn immediately and allow mutual transfers of SC/ST candidates with general candidates also.
